Next Way Paralegals will represent your best interests and navigate your charge(s) through the court proceeding. We will set out your options at various stages allowing you to make an informed decision.
Our duties include filing the ticket(s) with the provincial offences office, attending court, obtaining and reviewing the evidence being used against you for an effective defence and communicating with the prosecutor to discuss the charge(s) outside of court for a possible resolution without going to trial. If a trial is later required, we will effectively cross-examine the charging officer and any witness, as well as put forward your evidence through your or your witness’s testimony.
Not just traffic tickets
If you have a ticket (certificate of offence) or a summons to appear in Provincial Offences Court, you’re likely charged under the Highway Traffic Act, the Compulsory Automobile Insurance Act, the Cannabis Control Act, the Liquor Licence Act, the Fish and Wildlife Conservation Act or a city by-law.
Common charges
For traffic offences, they include speeding, red light fail to stop, disobey stop sign, no seatbelt, using handheld communication device (cell phone), follow too closely, fail to yield, careless driving, stunt driving, driving under suspension and driving without insurance.
If you are the driver or operator of a commercial motor vehicle, recurring charges include log book offences for failing to maintain daily log and equipment charges such as major or minor defects.
If you hunt, fish or trap and you are charged by a conservation officer, common charges include possess illegally killed wildlife, use firearm carelessly to hunt, unlawfully have loaded firearm, hunting or fishing without a licence and possess too many fish.
Your charter rights
The provincial offences court is bound by the Canadian Charter of Rights and Freedoms. We will ensure that your rights are protected throughout the proceeding and bring forward a motion for any infringement.
Appealing your conviction
You are wrongfully convicted or paid the ticket without being fully informed of the penalty. We can represent you in the appeal process which would be heard in the Ontario Court of Justice.
